TERMS AND CONDITIONS
HEY ALFRED CORP.
Dear Guest,
thank you for choosing HEY ALFRED CORP., a California corporation
("Hey Alfred", "we", "us"), for your stay.
These Terms and Conditions ("Terms") govern the reservation,
occupancy and use of the property ("Property") by the guest
identified in the booking ("Guest", "you"). By
booking, paying, checking in, or allowing any person to access the Property,
you expressly accept these Terms in full. Acceptance has the same legal effect
as a handwritten signature under the U.S. Electronic Signatures in Global and
National Commerce Act (E-SIGN, 15 U.S.C. §7001) and applicable state law.
1. RESERVATION, CHECK-IN AND CHECK-OUT
The Guest may
occupy the Property only during the dates and hours stated in the booking
confirmation. Early check-in or late check-out without authorization may result
in additional charges billed at the then-current nightly or hourly rate, plus
the cost of any resulting displacement of other guests.
2. MAXIMUM OCCUPANCY
Occupancy is
strictly limited to the number of persons stated in the booking. No discount
applies for lower occupancy. Any unauthorized additional person, whether or not
overnight, is a material breach and will result in per-person charges at the
prevailing rate and may result in immediate termination of the stay without
refund.
3. PAYMENT, CARD ON FILE AND AUTHORIZATION TO CHARGE
The Guest
authorizes Hey Alfred to store the payment card and/or bank information
provided at the time of booking (the "Payment Method") and to
charge the Payment Method for any and all amounts owed under these Terms,
including without limitation: (a) reservation fees and applicable taxes; (b)
charges for additional guests; (c) fines for violation of these Terms or house
rules; (d) any and all damage caused to the Property, its furnishings,
fixtures, equipment, or common areas, whether accidental, negligent, or
intentional, including damage caused by the Guest, co-occupants, invitees,
or pets; (e) extraordinary cleaning; (f) replacement of keys, access cards,
remotes, locksmith fees; (g) smoking, vaping, or drug-use remediation; (h) any
cost to restore the Property to its original condition; and (i) any other
charge expressly contemplated in these Terms.
This
authorization is a continuing authorization and remains in effect after
check-out until all amounts are paid in full. The Guest agrees that Hey Alfred
may charge the Payment Method without further notice or additional consent
for the categories listed above, and expressly waives any requirement of prior
authorization for each individual charge. If the Payment Method is declined,
the Guest remains fully liable and agrees to pay all amounts on demand, plus
interest at the maximum lawful rate and reasonable collection costs and
attorneys' fees.
A security
deposit or pre-authorization hold may be required. The existence, amount, or
release of any deposit does not limit the Guest's liability, and Hey Alfred may
charge amounts in excess of the deposit for damages or breaches.
4. CANCELLATION
Cancellations
are governed by the policy displayed on the booking platform at the time of
reservation. In the absence of an express policy: (a) cancellations outside the
permitted window are non-refundable; (b) no-shows forfeit the full amount paid;
(c) Hey Alfred may cancel without refund for breach of these Terms or failure
to provide requested information.
5. HOUSE RULES, PROHIBITED CONDUCT AND QUIET HOURS
The Guest
agrees to follow all posted house rules and any instructions provided by Hey
Alfred. The following are strictly prohibited: (a) smoking, vaping, or use of
any tobacco, nicotine, or drug product anywhere in the Property; (b) illegal
activity of any kind; (c) parties, events, or commercial use; (d) removing,
damaging, or misusing any property or furnishings; (e) unauthorized pets; (f)
subletting, assignment, or transfer of the reservation. Quiet hours are 10:00
PM to 8:00 AM local time. Violation of this section is a material breach and
authorizes immediate termination without refund plus all applicable charges
under Section 3.
6. PETS
Pets are
allowed only with prior written authorization or where the listing expressly
permits them. Unauthorized pets result in immediate termination, forfeiture of
all amounts paid, and charges for extraordinary cleaning and damages.
7. INSPECTION AND ACCESS
Hey Alfred or
its designated personnel may enter the Property with reasonable notice, or
without notice in the case of emergency, suspected violation of these Terms,
complaints from neighbors, or protection of the Property.
8. DAMAGE AND RESTORATION
The Guest is
fully liable for any damage to the Property, furnishings, equipment, common
areas, or amenities occurring during the stay, whether caused accidentally,
negligently, or intentionally, by the Guest, co-occupants, invitees, or
pets. Hey Alfred will document the damage (photographs, invoices, repair
estimates) and, pursuant to Section 3, will charge the Payment Method for the
full cost of repair, replacement, or restoration, plus any lost booking revenue
during the repair period. This obligation survives check-out.
9. ASSUMPTION OF RISK AND LIMITATION OF LIABILITY
The Guest
assumes full responsibility for the safety of themselves, their co-occupants,
invitees, and personal belongings. To the maximum extent permitted by law, Hey
Alfred is not liable for accidents, injuries, illness, theft, loss, or property
damage occurring during the stay, and Hey Alfred's total liability under these
Terms shall not exceed the amount actually paid by the Guest for the
reservation.
10. EARLY TERMINATION
Hey Alfred
may terminate the stay immediately, without judicial process and without
refund, for any material breach of these Terms. The Guest must vacate
immediately with all persons and belongings, and remains liable for all fines,
damages, and charges, and law enforcement may be contacted for assistance if
necessary.
11. NO CHARGEBACKS — DISPUTE RESOLUTION FIRST
The Guest
expressly agrees that all charges made by Hey Alfred under these Terms are
authorized, valid, and non-disputable via chargeback. The Guest represents
and warrants that services have been rendered as agreed (lodging made available
for the reserved dates, at the reserved Property) and that any additional
charges (damages, fines, extraordinary cleaning, additional occupants, or other
charges under Section 3) are supported by these Terms, which the Guest has
accepted.
If the Guest
has any question, objection, or dispute regarding any charge, the Guest agrees
to first contact Hey Alfred in writing at the email address on file within
thirty (30) days of the charge and to work in good faith to resolve the
dispute directly. The Guest expressly waives the right to initiate a
chargeback, dispute, or reversal with the card-issuing bank, payment
processor, or network (Visa, Mastercard, American Express, Discover) before
exhausting this direct dispute process.
The Guest
acknowledges that: (a) filing a chargeback for a charge authorized under these
Terms constitutes a breach of contract and a wrongful chargeback; (b)
Hey Alfred will provide the card network with a copy of these accepted Terms,
the booking confirmation, the IP and device information at the time of
acceptance, check-in records, damage documentation, and photographs, as
compelling evidence under card network operating rules to defeat the
chargeback; (c) if the Guest initiates a chargeback in breach of this Section,
the Guest agrees to pay Hey Alfred, as liquidated damages, the disputed
amount plus a $50 USD chargeback administrative fee, plus all costs of
defending the chargeback (including attorneys' fees) and any resulting card
network fines or penalties; (d) Hey Alfred may report wrongful chargebacks
to consumer credit and merchant risk databases (including Ethoca, Verifi, and
similar) and pursue collection through any lawful means.
This Section
survives termination of the stay and is a material inducement for Hey Alfred to
accept the reservation.
12. GOVERNING LAW, VENUE AND ELECTRONIC ACCEPTANCE
These Terms
are governed by the laws of the State of California, without regard to
conflict-of-law rules. Any dispute not resolved under Section 11 shall be
brought exclusively in the state or federal courts located in San Diego County,
California, and the Guest consents to personal jurisdiction and venue there.
The Guest waives any right to a jury trial and any right to participate in a
class action. If any provision is held unenforceable, the remainder shall
remain in full force. The Guest acknowledges having read, understood, and
accepted these Terms in full, and that acceptance by booking, paying, or
entering the Property has the same legal effect as a handwritten signature.
